By installing, copying, or using Picca you agree to this agreement with the person or company that sold or licensed Picca to you (Licensor). If you do not agree, do not use the software.
If you are a consumer in the United Kingdom or the European Economic Area, nothing in this agreement takes away rights you have under the Consumer Rights Act 2015, the Consumer Rights Directive, or other mandatory consumer law.
The Picca marketing website (including manuals and legal pages) is provided for information about the product. It does not grant you a licence to the desktop software. Use of the website is at your own risk. Do not send photos, face data, or other sensitive personal data through ordinary website contact unless Licensor has told you that channel is appropriate for support.
Subject to this agreement and your payment of any applicable fee, Licensor grants you a non-exclusive, non-transferable licence to install and use Picca on computers you own or control, for your own personal or internal business cataloguing of photographs.
You may make a reasonable number of backup copies. You may not:
Title to Picca remains with Licensor. Open-source and model components listed in the third-party licence notices remain under their own licences.
Picca helps you organise photos stored on your computer: folders, tags, captions, maps, optional on-device AI descriptions, and optional on-device face grouping.
Picca is not an identity-verification, law-enforcement identification, access-control, or biometric authentication product. Face detection and matching can be wrong. Names you assign are your labels, not proof of anyone’s legal identity. You must not rely on Picca to confirm who someone is, to make legal, employment, credit, or immigration decisions, or to identify people without a lawful basis.
Picca is designed so that your photo library, tags, captions, GPS metadata, thumbnails, and
face data are stored and processed on your computer in the catalogue database
and related folders (typically under .catalogue-data next to your library).
Licensor does not operate a Picca cloud account for this data and does not receive your photos
or face embeddings through normal use of the app.
Some optional features send limited data to third parties you choose to use (see the Privacy Policy): for example map tiles and place-name search via OpenStreetMap, first-time download of published AI model files, or a local Ollama server if you run one.
If you run face detection, Picca may create face embeddings (numeric templates derived from faces in your photos) and store them locally so it can suggest or apply person tags. Those embeddings can be biometric data under UK GDPR / EU GDPR and, in some US states (including Illinois BIPA), a biometric identifier.
By using face detection or face tagging you confirm that:
Licensor does not sell, lease, or trade biometric data, because Licensor does not receive it.
Picca uses open-source libraries and downloads published model files (for example SeetaFace, OpenCV Zoo YuNet and SFace, ONNX Runtime, llama.cpp, and Moondream2). Those components are licensed separately. This EULA does not replace those licences.
You are responsible for:
Licensor may provide updates. Updates may change features. Paid support, if any, is as described at the point of sale.
Picca is provided “as is”. To the maximum extent permitted by law, Licensor disclaims all warranties, including satisfactory quality, fitness for a particular purpose, and non-infringement. Licensor does not warrant that face matching, AI tags, maps, or GPS will be accurate or uninterrupted.
If you are a UK or EEA consumer, Licensor still supplies Picca with the quality, description, and fitness required by mandatory consumer law. That cannot be excluded.
To the maximum extent permitted by law:
This does not limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under applicable law.
This licence ends if you breach it. You may stop using Picca at any time. On termination, stop using the software. Your photos remain yours. You may delete the catalogue and face data as described in the Privacy Policy.
This agreement is governed by the laws of England and Wales. Courts of England and Wales have jurisdiction, except that if you are a consumer you may also bring proceedings in the courts of your place of residence where mandatory law so provides.
This EULA, the Privacy Policy, and the third-party licence notices are the commercial terms for Picca unless you have a separate written contract with Licensor. If a court finds a term unenforceable, the rest remains in effect.
